You correctly state three options MS has if they lose the appeal. How would they then look to the public at large (or at least the public who have an idea of what's going on) if they change the document storage format again?
I have heard many clients moaning about having to catch up to the latest (MS) document version. What if MS were to change it again so soon?
What about the ooxml submitted to ISO? It's not quite the same as the version in Office 2007 et al. Could MS use that? If they can't on the grounds of contravening existing software patents held by i4i, not only will MS suffer by either going back to .doc type formats or releasing yet another format, but the International Standards Organization will also be under renewed attack for allowing this flaw into the system along with the others we've been told about.
A failed appeal needn't be Microsoft's downfall, but I'm kinda hoping they fail just to see whether in the grand scheme of things the boat is really genuinely rocked this time. If it is, we might be able to look forward to new things from lesser-known developers. We'd all win from that.
