OK so he says that they could collect Biometric evidence of a presumed terrorist in some touristy place like Afghanistan. They then enter that data into the database back in the USA and the customs agents presumably become the "gatekeeper" that either blows the whistle on the incoming non-desirable or has him arrested. Hmmmm? Is that really going to happen? I don't think so.
Assuming that the guy can get a cell phone call to a US defense attorney before they ship him off to some place we haven't heard of yet, we might hear about it. The bad thing is that we haven't yet.
Where's the chain of evidence AND the court conviction that has "sentenced" this already convicted-without-a-trial traveler? Did the Army Sergeant leading the detail in Afghanistan collect the evidence? Was it collected from an Afghan national that didn't like the man who's now trying to get into the US? Was it collected in his old apartment that had been taken over by the Taliban and used to make bombs after he left? Was it DNA evidence collected from a dinner plate in a restaurant or a hot dog wrapper he had in the last airport before he got to the US?
Ok so we have to assume that he's a STUPID terrorist that wasn't smart enough to just WALK across the border from either Canada or Mexico or jump ship in one of about 300 harbors! If he has the IQ of a moron he's not going to register for a freaking ID card!
It is entirely the business of the US what their requirements are for non citizens to enter their country. Anyone who doesn't like it is perfectly free not to go there.
