Hard drive sizes as stated as UNFORMATTED capacity, once formatted the operting system/device must consume some of the capacity for it's own use in the format procedure. It is not misleading, and SOME manufacturers even state that this is unformatted capacity. I don't think this will win, they have the wrong idea.
