Story: Anti-spam law spurs torrent of complaints

As I followed up this 'anti-spam/cokie control' story from a Google News link I noticed that your site tried to place two cookies on my PC.
No request to post the cookies or statement of what they would be used for was given so I rejected them.
Is this use of cookies now legal, illegal or what?
And why is this very form I'm filling in now wanting my email address ? Am I implicitly opting into something ?
