Launching a counter-attack no matter how justified is a violation of USC Title 18, Section: 1030. As stated by this law, any computer is considered a "Protected Computer" if and I quote, “which is used in interstate or foreign commerce or communication, including a computer located outside of the United States that is used in a manner that affects interstate or foreign commerce or communication of the United States.”

Thus ANY computer connected to the internet, foreign and domistic.

Also keep in mind that an attacker can partner up someone to be an "innocent victim". The attacker will spoof the IP address and cause the counter attack to hit the "victim", which could result in a civil lawsuit against the counter-attacker (should the damage exceed $5,000 USD).

Please refer to www.cybercrime.gov before considering the use of active counter-attacking measures. Also contact the local FBI office and law enforcement authorities for current laws.
This is no longer Wild West and to use the words, "Fair Fight" in court isn't going to hold up along with the stray bullet(s) that hit an innocent bystander.
