The 1998 Merriam-Webster Dictionary states that a hacker is either "an expert at programming and solving problems with a computer" or "a person who illegally gains access to and sometimes tampers with information in a computer system."

The New Oxford Dictionary of English (1999) describes a hacker as "a person who uses computers to gain unauthorized access to data" or "an enthusiastic computer programmer or user."

Sounds like the author to me.
And to be honest, he hasn't really done any real damage anyway.
