Perhaps governments should allow hackers to report to them the companies hackers managed to breach the security of and then severly fine the company in question once the breach has been confirmed by them. Such regulation would lead to much more improved overall security then putting a man in jail who was stupid enough to not cover his tracks (which is rather easy).
As long as those that are in a position to actually make a positive change aren't burned by ignoring security problems within their world of influance this electronic world as a whole will stay enormously insecure.
