So? what is the issue?.
The data sharing will not stop between now and whenever a ruling is made.
Additionally, by the time such a ruling is made, a more loosely worded law will have been introduced, and probably worded such the the US will be able to obtain ALL personal information, let alone that required to purchase a flight

There will be further activation issues to watch out for as Microsoft plans to offer a similar service to independent software vendors whereby they can "control" licensing through activation and other measures similar to the Software Protection Platform.
