My Email server does not talk to my ISP ever, so how are they supposed to retain the data, and I am not going to.
Also with IM, P2P Skype etc are they supposed to retain the raw comms dialogue, decode it and store the translated data or what. This goverment again show that a little knowledge can be dangerous, and by heck they have little knowledge, obviously why they are happy with the quality of modern education.
